Booster Seat Regulations

As of August 8, 2013, Manitoba legislation requires children to use booster seats until one of the following things happens:

  • they are at least 145 centimetres (4'9") tall
  • they weigh 36 kilograms (80 pounds)
  • they are nine years old

Before giving up a booster seat, make sure the seat belt fits your child appropriately by ensuring that:

  • the seat belt fits across your child's shoulder and chest (not on your child's neck)
  • the middle of your child's ears should not come past the top of the vehicle's head restraint.  Make sure your child has adequate head and neck protection in case of a collision by adjusting the head rest.
  • Your child's knees should bend in line with the vehicle seat.

Continuing to use a booster seat until you are sure your child is safe without one is best.  Just make sure that your child's weight is not greater than the manufacturer's weight limit for the booster seat.

Important Car Seat Facts

  • Check if the car seat has been recalled by Transport Canada by visiting Transport Canada's website.
  • Replace a car seat if it has been involved in a collision as the impact of the accident can cause damage not visible.
  • Child care seats and booster seats are exempt from provincial sales tax.
  • Buy your car seat in Canada to make sure it meets with Canada's Motor Vehicle Safety Standards.  You can tell if this is the case by looking for the National Safety mark.
  • Check the car seat's expiry date.  Most seats are stamped with an expiry date on the back or the bottom of the seat.  If you can't find the expiry date, contact the manufacturer.  It's important to check the expiry date because over time, the plastic can crack.

If a driver is caught with children who should be in boosters not in booster seats, they are facing a $299 fine.
